As well as a one off application fee when applying for a Permit, each year a subsistence fee will need to be paid to the Local Authority to cover its regulatory costs. The fee is set by Central Government and changes on an annual basis. In addition fees may also be incurred in response to variation or transfer of a Permit.

Please note that the council may revoke any Permit where the subsistence fee is not paid.

How much is the Annual subsistence charge?

The annual subsistence fees are scaled in accordance with the severity of the polluting potential, the systems in place to mitigate this and any installed environmental management systems. These factors influence the extent of regulation and number of site visits that the Local Authority has a duty to undertake.

All installations and mobile plant are subject to a risk assessment, see below, and the permit subsistence fee is dependent upon the risk rating of the installation/mobile plant. The lower the risk rating, the lower the fee payable.

Risk Assessment

All operators are risk assessed, at least annually, using the methodology developed by DEFRA.

This risk assessment generally considers:

  • the nature of the permitted activities,

  • the progress with upgrading to the standards described in the relevant process or sector guidance notes,

  • the area surrounding the installation (i.e. the proximity and type of receptors),

  • any local air quality issues that the installation may contribute to,

  • the scale of previous compliance,

  • an assessment of installation record keeping, preventative maintenance and emissions and process monitoring,

  • an assessment of management and training systems.

The overall score obtained by the risk assessment determines the number and type of programmed visits that will be made to each installation over the following year, and, the subsistence fee payable.

When is the Annual subsistence charge due?

The operators of installations will be invoiced for the appropriate Permit subsistence fee at the beginning of each financial year. If required the subsistence charge may be paid by four, quarterly instalments. However, due to the additional administration required, an additional fee would be charged.

How do I pay my subsistence charge?

When you receive an invoice for the Permit subsistence fee, the payment methods are detailed on the back of all invoices and reminders. The options include:
