Infant Class Size Legislation
In law, no infant class may contain more than 30 pupils and be taught by only one qualified full-time teacher.
Under the School Standards and Framework Act 1998, an admissions authority can now refuse to admit a child to a school if the limit of 30 pupils has been reached and the admission of further pupils would cause "class size prejudice" and other limited circumstances.
Class size prejudice will result from the qualifying measures that would have to be taken in order to comply with the duty to limit class sizes to no more than 30 pupils and would have serious financial consequences for the Authority. Examples of qualifying measures include; employing an additional teacher, building an additional classroom or the introduction of mixed age teaching.
