On 14th September 2011 Dudley Council adopted its revised Planning Obligations Supplementary Planning Document (SPD) as part of the Council’s Local Development Framework. The SPD sets out detailed guidance on the Council’s planning obligation requirements, assisting all those involved in the submission and determination of those planning applications where planning obligations will be required in the Dudley Borough.
The review was required to take account the recently adopted Black Country Core Strategy and the Community Infrastructure Regulations which came into force in 2010. The review also provided an opportunity, in line with good practice, to improve the clarity of the SPD, better address viability considerations and ensure that the Council’s planning obligation requirements continue to be justified, reasonable and in scale with proposed new developments within the Borough.
The adopted Planning Obligations SPD is a material consideration in the determination of planning applications and therefore carries significant weight in the decision making process.
