Public Health

The Enforcement team is also involved with Public Health issues from domestic premises dealing with:

  • Filthy and verminous premises

  • Accumulations of waste at domestic premises

Dudley MBC has a statutory duty under the provisions of the Public Health Act 1936 and section 79 of the Environmental Protection Act 1990 to investigate complaints about premises

Accumulations of Waste


In accordance with the Environmental Protection Act 1990, the Enforcement section can deal with complaints concerning accumulations of refuse within the boundary of residential premises where there is a Public Health nuisance.

Overgrown or untidy gardens

Quite often complaints relating to untidy gardens are referred to us.  Unfortunately, there is little that we can do to enforce the tidy up of such gardens.  However, in exceptional circumstances where private land is in such a condition as to adversely affect the amenity of an area then action may be possible under Section 215 of the Town & Country Planning Act 1990.  At the moment these types of complaints are dealt with by our colleagues in Planning Enforcement.
