On 1st November 2006 Dudley MBC adopted its Statement of Community Involvement (SCI). This document includes information on how and when members of the public can get involved in all aspects of planning, whether it is commenting on individual applications or being part of policy formulation. The Council is required to conform to this document in undertaking its statutory planning functions.
Any person aggrieved by the Statement of Community Involvement may make an application to the High Court for permission to apply for judicial review of the decision to adopt the statement. Any challenge must be made on the grounds that either the document has not been prepared within the powers conferred by Part 2 of the Planning and Compulsory Purchase Act 2004 or alternatively that a requirement of the Act or associated Regulations has not been complied with. Any such application must be made promptly and in any event not later than 1st February 2007.
