On-Street Parking Bay For Disabled People

 
Disabled person's parking bays are marked parking bays on the street outside the homes of disabled residents. The Council investigate all requests for disabled parking bays using the criteria listed below.

The bays are provided for use by a specific individual (who are issued with a permit) and are legally binding, as they are made by Traffic Regulation Order. The parking bay is for the exclusive use of the permit holder and may not be used by any other driver, even other blue badge holders. Action could be taken by the police against unauthorised users.
 
To qualify for a disabled person's parking bay the following must be true:
  • You (or someone living with you), must have a car which is kept at your address.
  • You must be a blue badge holder
  • Your property must not have any provision for off-road parking, such as a drive or garage.(exceptions are sometimes made if the garage is remote)
  • It must be safe and feasible for a bay to be provided outside your home, and would not obstruct the use of any existing driveways.
 
Dudley Council will need to make a site visit to ensure that it is safe and feasible to provide a disabled parking bay outside the home of the applicant.

If the circumstances of a successful applicant change or they move from the address where the bay is located, they must notify the Traffic Section of Dudley Council as soon as possible.

Payment
Disabled person's parking bays are provided free of charge. There is, however, a limited annual budget for providing this service.

Q: I am a blue badge holder and have difficulty parking outside my home. Can you help me?
A: Yes – we have the blue badge bay scheme and as long as you meet the Council criteria we can try and introduce a bay as close to your property as possible.

Q: What are the criteria that an applicant has to meet to have a parking bay provided?
A:- As above

Q: How much does the disabled parking scheme cost?
A: There is no charge from the Council for this service, however your Doctor may make a small charge for the signing of your application.

Q: How do I apply for a disabled parking bay?

Q: Once you have received my application form and accompanying documents will I be issued with a bay?
A: As part of the process we carry out a thorough investigation of the location. If we are satisfied that you meet the criteria and there are no traffic management implications we will include your application within a Traffic Regulation Order (TRO). It takes several months for the legal process to make a TRO to be completed. Part of the process includes a period of public advertisement, which is carried out in the form of a public notice attached to a nearby lamp column.

Q: Are these bays enforceable and if so, who by?
A: The disabled parking bays are legally enforceable as they are made by TRO. This means that the bays are enforceable by the police. 

Q: I work at a doctor’s surgery – could you provide a bay to help the patients attending the surgery?
A: Again we may be able to help, but we have to be mindful that the introduction of a bay here may have an effect on parking generally in the area as these spaces can remain unoccupied for long periods of time.

Q: I have a blue badge yet I do not have a vehicle registered to my address. However on a daily basis members of my family visit me and help out by taking me out. Could you provide a bay for me?
A: We cannot provide a bay for carers who do not reside at the property. We understand the difficulties here, but cannot provide a bay that will remain unoccupied for long periods of time. We will in most instances look at others ways that may be of help to you in situations like these.

Q: You have refused my request for a disabled parking bay, what happens now?
A: You will be informed in writing of the reason your request for a bay has been refused. You can apply again if the circumstances surrounding the reason for refusal change.

Q: I have a disabled parking bay outside my current home – but I am moving house in a few weeks, what do I do?
A: You need to inform us that that you no longer require the use of the bay. If there is no other blue badge holder living in the immediate vicinity who meet the criteria and could utilise the bay, we will arrange to have the bay removed.

Q: I want to complain about abuse of a disabled parking bay in my road – is this possible?
A: Yes – it is important to us that we receive notification of any abuse of the disabled parking bay scheme. We will investigate the matter and instigate the appropriate action to be taken.

Q: I have a disabled parking bay but my permit has expired - I need to keep the bay, what do I do?
A: Please inform Traffic and Road Safety as soon as possible so that a new permit can be issued to you.
