NOTICE OF PUBLIC PATH ORDERS
TOWN AND COUNTRY PLANNING ACT 1990 SECTION 257 AND PARAGRAPH 1 OF SCHEDULE 14
BOROUGH OF DUDLEY (STOPPING UP AND DIVERSION OF PUBLIC FOOTPATHS, TREHERNS FARM, WORCESTER LANE, HAGLEY, STROUBRIDGE) ORDERS, 2008
NOTICE IS HEREBY GIVEN That the above Orders were made on 7
th of March 2008 under section 257 of the Town and Country Planning Act 1990, in order to enable development to be carried out in accordance with planning permission, application number P06/1278, granted under
Part III of the Town and Country Planning Act 1990 namely: the change of use from agricultural land to school sports pitches at Treherns Farm, Worcester Lane, Stourbridge.
The effect of the Orders, as shown on the order map, DC/CP/490/OP, will be:-
To stop up that length of public footpath S73, for its whole width, that commences at the southern end of public footpath S72 at point A, some 450 metres west of the Hagley to Stourbridge railway line, running in a generally south-easterly direction for approximately 195 metres to meet public footpath S69, at point B, adjacent the junction of S75, HE 501 and HE502.
To divert that length of public footpath S75, for its whole width, that commences at the southern end of public footpath S76, at point D, some 190 metres west of the Hagley to Stourbridge railway line, running in a generally south-westerly direction for approximately 220 metres meeting the junction of public footpaths S69, HE 501 and HE 502, at point C and create an alternative footpath, 3 metres wide, which will commence at the southern end of public footpath S76, at point D, to run in a generally southerly direction for 185 metres to terminate at its junction with public footpath HE 502, 135 metres east of the junction of public footpaths S69,HE 501 and HE 502, at point E.

Any representation about or objection to the Orders may be sent or delivered in writing addressed to Mr Kois Ali, Legal Services, 5 Ednam Road, Dudley, DY1 1HL not later than 10th of April 2008. Please state the grounds on which it is made.
If no such representations or objections are duly made, or if any so made are withdrawn, The Borough Council of Dudley may itself confirm the order as an unopposed order. If the order is sent to the Secretary of State for Transport for confirmation any representations and objections which have not been withdrawn will be sent with the order.

GATING OF A PUBLIC FOOTPATH ORDER
HIGHWAYS ACT 1980, SECTION 129A
This Order is made by Dudley Metropolitan Borough Council (“the Council”) under Section 129A of the Highways Act 1980 upon being satisfied that the following conditions have been met: -
(a) premises adjoining or adjacent to the highway are affected by crime or anti-social behaviour;
(b) the existence of the highway is facilitating the persistent commission of criminal offences or anti-social behaviour; and
(c) it is in all the circumstances expedient to make the Order for the purposes of reducing crime or anti-social behaviour.
BY THIS ORDER:
The Public Right of Way over the footpath commencing adjacent No 60 Murcroft Road running in a generally northerly direction between property boundaries for approximately 60 metres through two right angles to finish adjacent No 61 Wychbury Road will be restricted by the erection of a gate as outlined on the Plan TMD/CP/430 attached.
The footpath will be restricted at all times for a period of three years commencing from one month after the date on which this Order is made.
An alternative route for pedestrian traffic will be available via Murcroft Road, Queensway and Wychbury Road.
The gate will be maintained by David Jacobs, Project Engineer, Economic Regeneration Division, Mary Stevens Park, Stourbridge, West Midlands, DY8 2AA.

GATING OF A PUBLIC FOOTPATH ORDER

BOROUGH OF DUDLEY
Dudley Metropolitan Borough Council (“the Council”) propose to make the above mentioned Order, the effect of which will be to temporarily gate the public footpath namely the length of public footpath which commences at the Cemetery gates, approximately 30 metres south east of the south east facing boundary of number 3 Chase Road, running in a generally north easterly direction for approximately 260 metres to terminate between numbers 13 and 15 Cinder Road, as shown on Plan (TMD/CP/480)
The proposed Order will continue in force for a period of three years starting from one month after the date on which this order is made. The proposed hours of gating will be as follows:
- The months of April to October –18.00 hours to 09.00 hours
- The months of November to March – 16.30 to 09.00 hours
An alternative route for pedestrians will be provided via Chase Road and Cinder Road.
The proposed Order is shown in the Schedule below:
SCHEDULE
This Order will be made by the Council under Section 129A of the Highways Act 1980 because it appears to the Council that a Gating Order will alleviate persistent crime and anti-social behaviour at Gornal Wood Cemetery, Gornal.
The general effect of the proposed Order is that the Public Right of Way over the footpath will be restricted by the erection of a gate at both ends, as outlined in the plan, which will remain locked during the stipulated times to the effect that the public will not have access thereto.

Any representation as to whether or not the gating order should be made shall be sent or delivered in writing addressed to David Jacobs, Project Engineer, Economic Regeneration Division, Mary Stevens Park, Stourbridge, West Midlands, DY8 2AA to arrive no later than twenty eight days from the date of this notice.
The Council shall consider any representations as to whether or not the gating order should be made whether in response to this notice or otherwise.
