In virtually all cases, the Highway Authority is responsible for the maintenance of the surface of a public right of way.
It is not, except by agreement or for some structural reason, responsible for fences, hedges and free standing walls. Maintenance of such boundaries lies with the adjacent landowner. Failure to properly maintain those boundaries, to the detriment of the users of the path, could lead to legal action.
The ownership of the land over which the path passes does not lie with the Council unless it, itself, is the freeholder of that land.
