23 - Pensioner evicted from home for anti-social behaviour

 
A Brierley Hill pensioner has been evicted from his home and given a five-year anti-social behaviour order after verbally abusing his neighbours and making violent threats.
 
Dudley Council was granted the orders against Sukhdev Uppal, aged 70, of Victoria Road, Quarry Bank, at Stourbridge County Court on April 15.
 
The court heard how neighbours had complained since 2001 about Uppal’s behaviour including abusive language, violent threats, drunken behaviour and inviting youths to his property who then engaged in anti-social behaviour.
 
The court also heard how Uppal had repeatedly misused the 999 emergency services number, attempted to stop people visiting other residents in the flats and slamming and banging doors.
 
Dudley Council’s housing services team had tried to help Uppal for several years with his personal problems, but without success.
 
The court granted a 28 day possession order of his home and a five-year anti-social behaviour order.  The ASBO will take effect once it has been served on him in the next few days.
 
Under the order Uppal must not:
 
·        Enter Victoria Road, Quarry Bank, Brierley Hill, West Midlands, at any time and for any reason after May 14, 2008;
 
·        Use threatening, abusive, insulting or indecent words against any person within the area of Dudley borough;
 
·        Be drunk in a public place anywhere within the Dudley borough;
 
·        Approach or make contact with, either directly or indirectly, residents in Victoria Road, Quarry Bank, Brierley Hill.
 
·        Engage in any type of noise nuisance, including, but not limited to: banging of doors, shouting and swearing and verbal abuse, anywhere within the Dudley borough;
 
·        Enter into any office of Dudley Council’s Adult, Community and Housing Services, without an appointment notified to him in writing;
 
·        Contact the police, whether by any electronic means, including telephone, or by personal communication, unless it is for a legitimate matter requiring police involvement;
 
·        Make telephone calls to the 999 emergency service unless it is a case of a genuine emergency;
 
·        Behave in an anti-social manner which causes or is likely to cause harassment, alarm or distress to any person or persons within the area of Dudley borough;
 
·        Encourage, incite or instruct any other person to behave in an anti-social manner which causes or is likely to cause harassment, alarm or distress to any person or persons within the area of Dudley borough, including:
  
(i)            using threatening, abusive, insulting or indecent words or behaviour against any person within the Dudley borough;
 
(ii)          engaging in any type of noise nuisance, including, but not limited to: banging of doors, shouting and swearing and verbal abuse, anywhere within the Dudley borough.
 
Dawn Hewitt, head of community safety for Dudley Council said:
 
“The local authority has offered help to Mr Uppal, and this action is always a last resort.
“But we have a duty to support and protect all residents across the borough.
“Mr Uppal has caused considerable distress to his neighbours and I now hope that they can live in peace and quiet, as we all have the right to do in our own homes.”
