Terms and conditions for the garden waste collection service

The following terms and conditions govern your subscription to our garden waste collection service.

  1. This agreement is made between the resident (the customer) and Dudley Metropolitan Borough Council. It sets out terms and conditions under which the customer may use the Council’s chargeable garden waste fortnightly collection service.
  1. Garden waste collections will run for 50 weeks from 1st April 2024 to March 2025. Collections will only be available for customers who have subscribed to the service. The service will be suspended for two weeks over the festive and New Year period. Each customer will receive twenty-five collections subject to these terms.
  1. Collection dates will be available via the QR code on the permit or by visiting https://www.dudley.gov.uk/garden-waste/.
  1. Customer subscriptions are renewable annually. Only customers who have paid their subscription are eligible to receive the service subject to any increase in the annual fee under clause 5.
  1. The subscription consists of an annual charge to the customer set by the Council for the period April to March each year. The Council determines the cost of the service on an annual basis.
  1. There are no reductions for subscribing to the service part-way through the year.
  1. Wheelie bin(s) or garden waste sacks shall be kept on the property that the subscription is ordered against. If you move house, you must notify the Council, and we will arrange for a new permit to be sent to your new address; the green bin must remain at the old property with the permit removed. The annual charge is for service administration and collections only. If a new bin is required at the new property a replacement bin charge applies.
  1. The council accepts no liability for the wheelie bin(s) used for any other purpose other than for the collection of household garden waste. Misused bin(s) may be removed by the Council.
  1. The Council may stop taking orders for the garden waste service at any time within the service year.
  1. Missed collections must be reported after 3pm on the day of collection or on the following working day by using MyDudley or by calling Dudley Council Plus on 0300 555 2345. We will aim to return to collect the bin within seven working days.

  2. If we are unable to empty your bin because it was not presented by 6am on your collection day, it contained the wrong waste, it was too heavy, or the waste was compacted or frozen, we will not carry out a return collection. Your bin will not be emptied until the next scheduled date. There will be no refunds if we cannot collect the bins for these reasons.
  1. We will not return to a missed bin if the driver has reported it as not being out; the customer will have to wait until the next scheduled collection.
  1. We will not return to a bin that has been reported as contaminated. Contaminated items must be removed for the next scheduled collection. Details of items which must not be placed in the garden waste bins can be found at https://www.dudley.gov.uk/garden-waste.
  1. Contaminated bins lead to contaminated loads. These incur additional unnecessary spend to separate. The Council reserve the right to suspend collections from any property that continually contaminates the bin, and a refund will not be issued.

  2. If collections are suspended because of snow or other operational issues, we will do our best to return as soon as possible. If we cannot return to empty your bin, we will not offer any refunds.
  1. The customer is required to ensure that the bins are only used for the storage of garden waste for collection. The Council accepts no liability for the loss of any materials placed in the bin for disposal or otherwise. This includes parcels placed in the wheelie bin by delivery companies.
  1. For the avoidance of doubt, if a customer arranges for the collection of garden waste where there have been missed collections via a third party, the council will not be responsible for any third-party costs incurred by the customer.
  1. The service will empty a 240l wheelie bin that the Council has supplied. We will not empty any other wheeled bin not issued by the Council. If the customer’s property is not suitable for a wheeled bin collection, an alternative method of collection will be provided, namely the issue of 2 x 120-litre reusable bags.
  1. There is no alternative bin size available, so residents who have large gardens may subscribe to receive multiple wheeled bins up to a maximum of four. There will be a cost for each individual bin plus the annual subscription per bin as set out by the Council.
  1. Wheelie bins must be presented on the backline of the pavement/edge of the property at the front of the house. If a property is in a private driveway, the wheeled bin will need to be placed where the private drive meets the pavement.
  1. Wheelie bins must be presented on the customer's scheduled collection day by 6am (or no earlier than 6pm the day before) and then retrieved by the customer as soon as possible following collection.
  1. Once the customer has signed up and paid for the service, there is a 14-day cooling-off period when the customer can cancel the service. If the customer has received a collection during the 14-day cooling off period, the Council reserves the right to charge a reasonable fee for the collection, permit and administration fee to process the cancellation; this fee is £15.00, and you will be issued a partial refund of £21.00. If you wish to appeal the partial refund, appeals will only be heard upon receipt of your original permit, unopened, if it has been dispatched.
  1. After the 14-day cooling-off period, the Council will not refund any payments made.

  2. By signing up to the service, you agree to be contacted by email (if an email address is provided) to be reminded to sign up for the service in future years.
