Dudley Council has adopted this policy on financial penalties and prosecution under the relevant lettings agency legislation.

It applies in relation to any decisions made by the Council in its capacity as an Enforcement Authority under sections 6, 7 and 26 of the Tennant Fees Act 2019 respectively.

"Relevant letting agency legislation" means:

  • The Tenant Fees Act 2019 (the TFA 2019)
  • Chapter 3 of Part 3 of the Consumer Rights Act 2015 as it applies in relation to dwelling houses in England
  • Regulations under Sections 133 – 135 of the Housing and Planning Act 2016 pertaining to The Client Money Protection Schemes for Property Agents (Requirement to Belong to a Scheme etc) Regulations 2019
  • An order under Section 83(1) or 84(1) of the Enterprise and Regulatory Reform Act 2013 pertaining to The Redress Schemes for Lettings Agency Work and Property Management Work (Requirement to Belong to a Scheme etc) (England) Order 2014
