Dudley Council’s powers to control noise from construction sites that may affect local residents are contained in the Control of Pollution Act, 1974.

Section 60 & 61 of the Control of Pollution Act 1974

Under Section 60 of this Act, the council may serve a notice imposing requirements as to the way in which works are to be carried out. Please note that Section 60 & 61 of the Control of Pollution Act 1974 can only be used to control noise from construction sites, not dust or air quality.

Such a notice may, in particular:

  • specify the plant or machinery which may be used,
  • specify the hours during which the works may be carried out,
  • specify noise levels which must not be exceeded,
  • provide for any change of circumstances.

Statutory Nuisance provisions of Part III of the Environmental Protection Act 1990

The Statutory Nuisance provisions of Part III of the Environmental Protection Act 1990 may also be used for pollution control from construction activities as well as a large variety of other situations.

Any requirements made by the council could vary according to such factors as the type and extent of the work being undertaken and the site location in relation to the surrounding residences.
